Section 01
Acceptance of Terms
By accessing or using MotorFest Pro (the "Service"), including creating an account, browsing the site, or using any feature — including the Otto AI tuning assistant — you agree to be bound by these Terms & Conditions ("Terms").
If you do not agree to these Terms, please do not use the Service. Continued use of the Service after any modification to these Terms constitutes your acceptance of the revised Terms.
These Terms constitute a legally binding agreement between you and MotorFest Pro. Please read them carefully.
Section 02
Eligibility
You must be at least 13 years of age to use MotorFest Pro. If you are under 18, you confirm that you have obtained parental or guardian consent to use the Service, including any paid features.
By using the Service you represent and warrant that:
- You meet the minimum age requirement above.
- You have the legal authority to enter into these Terms.
- Your use of the Service will comply with all applicable local, national, and international laws and regulations.
Section 03
User Accounts
To access certain features, you must register for an account using a valid email address and a secure password. You are responsible for:
- Keeping your account credentials confidential.
- All activity that occurs under your account.
- Notifying us immediately if you suspect unauthorised access.
Usernames may only be changed once every 90 days. Usernames must not impersonate another person, use offensive language, or violate any third-party rights.
We reserve the right to suspend or terminate accounts that violate these Terms, contain misleading information, or engage in disruptive or harmful behaviour.
Section 04
Otto AI — Usage & Disclaimer
Otto is an AI-powered tuning assistant built into MotorFest Pro. It generates car setup and tuning suggestions based on your inputs and is designed to assist with in-game tuning in racing titles such as Forza Motorsport and similar games.
Important: Otto's suggestions are generated by artificial intelligence and are provided for entertainment and gaming assistance purposes only. They do not constitute professional automotive, mechanical, or engineering advice. Do not apply AI-generated tuning suggestions to real-world vehicles.
By using Otto you acknowledge and agree that:
- Otto's output may be inaccurate, incomplete, or unsuitable for your specific use case.
- MotorFest Pro makes no guarantees regarding the accuracy, reliability, or performance of Otto's suggestions within any game.
- You use Otto's suggestions entirely at your own risk.
- MotorFest Pro is not liable for any loss — including in-game performance issues — resulting from use of Otto's suggestions.
- Otto responses are generated by a large language model and may occasionally produce unexpected or incorrect outputs.
We reserve the right to modify, suspend, or discontinue Otto or any of its features at any time without notice.
Section 05
Credits & Payments
Otto operates on a credit-based system:
- Free credits: Every registered user receives 10 free credits per calendar month, automatically refreshed at the start of each monthly cycle. Unused free credits do not roll over.
- Paid credits: Additional credits can be purchased at any time:
- 12 credits — $3.99 USD
- 30 credits — $8.99 USD
- One (1) credit is consumed per successful Otto interaction.
- Credits have no cash value and are non-transferable between accounts.
All payments are processed securely through Stripe. MotorFest Pro does not store your payment card information. By completing a purchase you also agree to Stripe's Terms of Service.
Prices are listed in USD and may be subject to applicable taxes depending on your jurisdiction. MotorFest Pro reserves the right to adjust pricing at any time with reasonable notice.
Section 06
Refund Policy
All credit purchases are final and non-refundable once a transaction is completed, except where required by applicable consumer protection law.
Refunds may be considered in the following exceptional circumstances:
- You were charged but credits were not added to your account due to a technical error.
- You were charged twice for the same transaction.
To request a refund under these circumstances, please contact us within 14 days of the purchase date with your order details. We will investigate and respond within 5 business days.
Refund requests submitted after 14 days of purchase, or for credits that have already been used, will not be eligible for a refund.
Section 07
User-Generated Content
MotorFest Pro may allow you to create, share, or publish content such as tuning setups, build notes, and community posts ("User Content"). By submitting User Content you:
- Confirm you own or have the right to share the content.
- Grant MotorFest Pro a non-exclusive, royalty-free, worldwide licence to display and distribute the content within the Service.
- Agree not to post content that is unlawful, offensive, harassing, misleading, or in violation of any third-party rights.
We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable, without prior notice.
Section 08
Privacy & Data
Your privacy matters to us. When you use MotorFest Pro we collect and process certain personal data, including:
- Email address and username (for your account).
- Usage data related to your interactions with Otto.
- Payment processing data handled by Stripe on our behalf.
We use this data solely to operate and improve the Service. We do not sell your personal information to third parties.
Account data is stored securely via Supabase with row-level security. Authentication is managed through Supabase Auth.
You may request deletion of your account and associated data at any time by contacting us (see Section 12). We will process deletion requests within 30 days, subject to any legal retention obligations.
Section 09
Prohibited Conduct
You agree not to use the Service to:
- Violate any applicable law or regulation.
- Attempt to reverse-engineer, scrape, or exploit any part of the Service or its AI systems.
- Abuse, harass, threaten, or impersonate other users.
- Circumvent credit systems, rate limits, or authentication controls.
- Use automated tools (bots, scrapers) to interact with the Service without authorisation.
- Share, resell, or redistribute Otto outputs or generated content for commercial gain without our written permission.
- Upload malicious code or otherwise interfere with the integrity of the Service.
Violation of these prohibitions may result in immediate account suspension or termination without refund.
Section 10
Limitation of Liability
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the fullest extent permitted by law, MotorFest Pro and its operators shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages.
- Loss of data, profits, or goodwill arising from use of the Service.
- Interruptions, errors, or downtime of the Service.
- Actions taken based on Otto AI-generated suggestions.
Our total liability to you for any claim arising out of these Terms shall not exceed the amount you paid to MotorFest Pro in the three months preceding the claim.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such cases, our liability will be limited to the maximum extent permitted by applicable law.
Section 11
Changes to Terms
We may update these Terms from time to time to reflect changes in the Service, applicable laws, or our business practices. When we make material changes, we will update the "Last updated" date at the top of this page.
We encourage you to review these Terms periodically. Continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
